Scottsdale looks to settle accident case with $55K payment

A settlement is in play for the city of Scottsdale as the local governing board will decide whether to dish out $55,000 to avoid any further litigation in the case Privette v. City of Scottsdale.

This case stems from Nilsene A. Privette taking legal action against the city for a trip-and-fall accident at the intersection of Indian School Road and Marshall Way on Aug. 31, 2013, according to a city staff proposal.

Ms. Nilsene brought a negligence lawsuit against the city with an original Notice of Claim totaling $225,000 from the city, the proposal states.

According to the proposal, paying the settlement would result in the dismissal of the case and termination of the litigation. This would mean, the city would remove any additional costs of proceeding with the litigation, the proposal states.

If the city council approves the settlement at its Tuesday, Oct. 25 city council meeting, payment of the settlement will proceed after the execution of the necessary paperwork, according to the proposal.
