Scottsdale reaches settlement with former employee

The city of Scottsdale has reached a settlement with Nicole Rerucha, a former city employee who is alleging the city did not provide her an alternative work schedule after her doctor limited her working schedule.

According to a staff proposal, Ms. Rerucha worked for the city until 2012, when she was “medically separated,” from the employment after her doctor restricted her to only working two days per week.

Additionally, the proposal stated Ms. Rerucha brought a suit against the city claiming the city did not provide an alternative work schedule as a reasonable accommodation. The proposal also stated the city denies liability.

In front of a Federal Magistrate, both parties reached a settlement for the city to pay Ms. Rerucha $135,000, the proposal stated. The settlement needs the city council’s approval at the Monday, Oct. 10 city council meeting to move forward with processing and payment.

According to the proposal, staff is recommending the city council approve the settlement because “the cost, uncertainty and risk of going forward to trial in this case far outweigh the amount of the negotiated settlement.”

If the city council approves the settlement, then the city will move forward with settlement papers and paying Ms. Rerucha in a timely manner, according to the proposal.
